THE HIGHWAY CODE AND CYCLISTS

The Highway Code sets out the rules and guidance for all road users in Great Britain. In 2022, the Highway Code was updated to introduce a hierarchy of road users, placing cyclists above car drivers in terms of priority. Key rules for cyclists include riding in single file on narrow roads, using cycle lanes where available, and ensuring their bike is roadworthy.

NEGLIGENCE AND DUTY OF CARE

At the core of most cycling accident claims is the legal concept of negligence. A driver or third party owes cyclists a duty of care — meaning they are legally obligated to take reasonable steps to avoid causing harm. When they breach this duty and injury results, they are considered negligent and may be liable for compensation.

LIMITATION PERIOD

In the UK, you generally have three years from the date of your cycling accident to bring a personal injury claim. Missing this deadline can mean losing the right to claim altogether.
