YOUR LEGAL RIGHTS AS A CYCLIST
Cyclists have the same legal rights on the road as any other road user. Drivers are legally obliged to share the road safely and to give cyclists adequate space when overtaking. When a driver’s negligence results in injury to a cyclist, the cyclist has a legal right to seek compensation.
It is important to understand that contributory negligence can affect your claim — for example, if you were not wearing a helmet or were cycling without lights at night. However, contributory negligence rarely eliminates a claim entirely; it may simply reduce the amount awarded.
CYCLE INSURANCE — DO YOU NEED IT?
Cycle insurance is not legally required in the UK, but it is strongly advisable. A comprehensive cycle insurance policy can cover theft of your bike, accidental damage, personal accident, and third-party liability. Having insurance in place can ease the financial impact of an accident while your claim is being processed.
Note that making a claim through your insurer and making a personal injury claim against a third party are separate processes — you may be entitled to pursue both.
